GENERAL TERMS AND CONDITIONS

WHEN USING THE ONLINE BOOKSTORE OF THE MEDICAL UNIVERSITY OF VARNA

The current TERMS AND CONDITIONS determine the exchange between the Medical University of Varna “Prof. Dr. Paraskev Stoyanov”, 55. Marin Drinov Str., UIC 000083633, VAT No. BG000083633, (hereinafter designated as the Online Bookstore of the Medical University of Varna) on one side and the CUSTOMERS using websites and services, found at the following address https://books.mu-varna.bg/.

The CUSTOMER of the Online Bookstore of the Medical University of Varna ACCEPTS and AGREES WITH THE GENERAL TERMS AND CONDITIONS, published on the website.

The published information is with open access and free of charge.

1.      CUSTOMER DUTIES

When using the services of the Online Bookstore the CUSTOMER has the obligation to adhere to the current conditions, as well as all other conditions set by the legislation system of the Republic of Bulgaria, even if they are not mentioned in the current terms and conditions.

The services of the Online Bookstore could only be used by registered CUSTOMERS. The registration gives the CUSTOMER the following advantages – automatic filling out of the data when placing an order, monitoring the status of the active orders, purchase history, providing support of a wishlist.

When registering, the CUSTOMER must fill out a registration form and indicate in it correct identification information, needed when shipping the product and issuing an invoice. The registered CUSTOMERS voluntarily submit their personal information when registering at the Online Bookstore. They have the right to edit their personal information at any time, in regard to its correctness, accuracy, present state and adequacy. They can also ask to have their customer profile deleted.

Agreeing with the current terms and conditions, the CUSTOMERS, who have registered a username and password, agree to have the submitted by them personal information processed digitally for the purpose of shipping the ordered products and when the help of the administrator of the Online Bookstore of the Medical University of Varna is needed.

The Online Bookstore of the Medical University of Varna guarantees that it will not give access to the personal information of the registered CUSTOMERS to third parties for advertising or promotional purposes, as well as for other purposes, except when it is needed for reasons stated in the legislation of the Republic of Bulgaria.

2.     PLACING AN ORDER

The shipping of products through the Online Bookstore is done after placing an order for shipping a product, in which the CUSTOMER indicates a first name and a surname, a shipping address, a valid e-mail and phone number. Each order receives an automatic number and is confirmed by phone by a representative from the Online Bookstore. The order confirmation is done within the same workday if it is placed before 15.00 h, or the day after if it is placed after 15.00 h. All orders placed on a non-working day are confirmed on the first workday after that.

The working hours of the Online Bookstore of the Medical University of Varna are:

Monday - Friday: 8.30 – 17:00

Saturday and Sunday – days off, no orders are being processed.

The CUSTOMER can place a pre-order of a book which is expected to be published and exists as a to-be-published title at the Online Bookstore. The processing of the order is done after the publishing of the book within the standard delivery terms.

3.    PRICES, SHIPPING AND PAYMENT

The Medical University of Varna has the right to change the prices at all times whenever there is a need for it, without being obliged to inform the CUSTOMERS. The CUSTOMER must pay the price indicated during the time of the order, regardless of whether it is lower or higher than the current one. The message indicating the reduced price is placed right next to the previous price, which is crossed out. If there is no timeframe for the reduced price, it is valid until the product is sold out.

The delivery is done through the delivery company announced on the website of the Online Bookstore. The CUSTOMER can choose the delivery address (the delivery company’s office or a different one). The shipping costs are indicated on the website of the Online Bookstore and are available at the moment of placing the order by the CUSTOMER.

If the CUSTOMER would like to use the services of a different company, they must state that during the order and pay the shipping rates of the indicated delivery company.

The CUSTOMER can receive the ordered product also directly from the bookstore of the Medical University of Varna at: Varna, 55 Marin Drinov St, Rectorate, 74 Tsar Osvoboditel Blvd, Medical College, and 1 Hristo Smirnenski Blvd, UMBAL Sv. Marina. In this case there is no shipping cost.

The Online Bookstore has the right to change the delivery company without notifying the CUSTOMER in advance, as long as that does not change the way of shipping, except in the cases when the CUSTOMER has chosen a specific delivery company.

The payment of the ordered products from the Online Bookstore is done via payment on delivery in cash to the delivery company, at the moment of delivery. POD is valid only within the territory of Bulgaria.

In case the product cannot be delivered, a representative from the Online Bookstore can offer an alternative product with similar characteristics and price which the CUSTOMER could accept or decline.

 4.     COMPLAINTS AND RETURN POLICY 

According to the Consumer Protection Act and the Online Trade Law, the CUSTOMER who has bought a product from the Online Bookstore has the right to file a complaint if:

• there is something missing,

• the product is defective.

The CUSTOMER has the right to file a complaint within 14 days after buying the product. When filing a complaint the CUSTOMER has the right to have the product replaced with another one. If the price of the chosen product exceeds the paid amount, the CUSTOMER has to pay the difference.

The return of the product is done under the following conditions:

• well-preserved appearance (the product is not torn, scratched, crushed, etc.);

• there are no damages caused by improper handling;

 • well-preserved original packaging.

The delivery costs when returning a product are paid by the CUSTOMER, except for the cases when the return is due to a mistake made by the Online Bookstore. When replacing a product by wish of the CUSTOMER, the delivery costs in both directions are paid by the CUSTOMER.

Apart from the cases of complaint, the CUSTOMER has the right to cancel the contract, according to the provisions of art. 50 of the Consumer Protection Act.

In order to replace or return a product the CUSTOMER must call +35952677112 during the working hours of the Online Bookstore.

5.     PROTECTION OF PERSONAL INFORMATION. CONFIDENTIALITY POLICY

The Online Bookstore of the Medical University of Varna collects and process the personal information, submitted by the CUSTOMERS, in accordance with the Personal Information Protection Act. The personal information is used to receive and fulfil orders, to supply information in the form of databases and to contact the customers in cases of problems in regard to the order. Personal information (Name, Address, Phone, E-mail) can be sent to the delivery company so that they would be able to deliver the order to the CUSTOMER.

The Varna Medical University Press does NOT collect personal information such as Personal Identification Number, ID card number and other personal documents. The collected personal information – names, valid addresses, phone numbers, emails – are needed for the registration process at the Online Bookstore of the Medical University of Varna and in order to establish business-related communications.

Personal information will not be given, in any form, to third parties and it will not be used for purposes, different from the aforementioned. All personal information can be deleted from the database of the Online Bookstore at any moment at the request of the CUSTOMER.

According to the Personal Information Protection Act, the CUSTOMER has the right to have access to their own personal information, submitted or available to the Online Bookstore, as well as to edit this information.

The Online Bookstore does NOT send the registered users unsolicited messages. If the CUSTOMER would like to receive newsletters, information and advertising materials, they have to specifically mention this during the process of registration.

6.      RESPONSIBILITIES

The Online Bookstore of the Medical University of Varna has the right to change at any time its content (technology, design, prices), without having the obligation to inform in advance the CUSTOMERS about the changes. The changed general terms and conditions are published on the website of the Online Bookstore and are accessible to all CUSTOMERS. The Online Bookstore does not bear responsibility if the CUSTOMER has not read the latest version of the current terms and conditions.

The Online Bookstore of the Medical University of Varna has the right to change at any time the content and the way of information access in it, as well as to terminate its use in cases of illegal access, wrongdoings and such which are against the laws of the country.

In case of not observing the rules of using the Online Bookstore of the Medical University of Varna or violating the ethical policy, the administrators of the website have the right to limit the access to the online store of the violators.

7.   APPLICABLE LAW

In all cases not mentioned in these terms and conditions, the current provisions of the Bulgarian legislation system are applicable.
